This document serves as the Terms of Service, Acceptable Use Policy, and Privacy Policy for EasyHost4You, all services it provides, and all interactions it enters into. This document describes the services offered, the prohibited actions and the interactions we will and will not have with your data. We reserve the right to modify this document at any time with or without notice.
This agreement is sometimes referred to as the "Terms of Service" or "Agreement". We may refer to ourselves as "We", "us", or "EasyHost4You" in this Agreement. Our current and potential customers are referred to as “customer(s)”, “customer(s)”, “user”, “user” and/or “You” (the customer).
EasyHost4You provides an easy and reliable dedicated game server hosting solution for organizations and individuals. Our service allows these parties to play their multiplayer games on your servers. Additionally, we will provide highly knowledgeable, quality customer support to help customers maximize the use of their game servers on EasyHost4You computer systems.
EasyHost4You provides internet connectivity, game server management, and data storage, which EasyHost4You makes remotely accessible for a monthly fee.
Depending on your product, service and term selection, you will receive a default configuration of the server application or compatible service of a certain capacity for a certain monthly fee, both of which are determined when you become a customer from EasyHost4You.
You agree to pay all recurring charges when due in accordance with the agreed billing terms set forth at the commencement of the Services. We reserve the right to contract with a third party to process all payments. This third party may impose additional terms governing payment processing. Your account will be deemed past due if it is not paid in full by the payment due date. Your card issuer's agreement may contain additional terms regarding your rights and responsibilities as a cardholder. We reserve the right to change our fees and billing methods, including adding additional fees for any content or service we provide, with or without notice, at any time. This site uses automatic recurring billing cycles through third-party payment gateways such as PayPal and Stripe.
In return for these payments, your server application will receive best-effort connectivity to the public Internet. You will also receive technical assistance for technical problems related to your service and its use.
Technical support will be provided whenever possible. You agree that the computer system that hosts your server applications and services will require downtime for maintenance, for which you will generally receive four hours notice. You agree that in some cases you will receive less notice. You agree to EasyHost4You's policy of always choosing service availability over data integrity if the two conflict. You accept that data loss may occur and you are responsible for backing up your files. As it is important to maintain high availability, data loss is acceptable.
EasyHost4You does not review the private content of client files. If an anonymous person on the Internet can't access it, we won't access it.
However, during normal operation and maintenance, we may observe certain metadata such as file names, configuration settings, and Internet traffic statistics.
You agree that EasyHost4You may review the contents of your files as necessary during customer support interactions initiated by you. EasyHost4You does not permanently store customer activity logs. We regularly destroy the logs. We only store metadata related to the use of our service.
We will not disclose any data or metadata regarding our customers' behavior, the private content of their files, or their records for billing purposes, to any agent or law enforcement agency without a direct order from a competent US court. We will provide immediate notice to any customer named in such court order, and access to their service will not be terminated unless specifically prohibited by the court order.
EasyHost4You was founded by former engineers, developers and gamers exposed to many technologies and gaming projects. When EasyHost4You was founded, we agreed not to disclose personal or consumer information of any kind it be on our customers to any party for any reason unless explicitly authorized by our customers.
This Acceptable Use Policy complies with all federal, state, and local laws, and protects the security and continuity of the computer systems operated by EasyHost4You and the services offered by EasyHost4You.
EasyHost4You's customers agree not to store any data on EasyHost4You's computer systems that violates United States law, the laws of any state in which EasyHost4You does business, or the local laws of any localities in which EasyHost4You does business. activities.
EasyHost4You customers also agree not to participate in or assist others to access a EasyHost4You computer system in a manner in which it is not already made accessible, or to access any private customer data that is not their own.
You represent and warrant that you are at least 13 years of age and have the legal capacity to enter into this Agreement. If you are not at least 13 years old, you must immediately stop using our Services and may not use or access our Services. Teens between the ages of 13 and 17 must have permission from a parent or legal guardian to access and use our Service. You agree not to circumvent any security and/or access features installed by us. Additionally, we assume no responsibility for any misrepresentation of a user's age.
EasyHost4You provides the services listed above, as well as any other services provided in the future on a BEST EFFORT basis. NO WARRANTIES ARE EXPRESS OR IMPLIED regarding the retention, integrity, continuity or availability of the data. Your data may become unavailable or be destroyed by any event, not limited to fire, flood or natural disaster.
EasyHost4You describes and references, in its communications and documentation and otherwise, numerous software applications, methods, and practices of EasyHost4You and third parties. You agree that EasyHost4You makes no representation, claim or promise that such software provides any level of function, is safe, secure or fit for any purpose.
When you purchase a subscription from our website, you authorize your payment method (credit card, bank, paypal, or debit card) to be billed recurring every 30, 90, 180, or 365 days depending available payment terms. for each product. We give you the ability to cancel your automatic subscription(s) at any time during the billing period by going to the My Account area of our website and clicking Cancel next to the subscription you no longer wish to keep. Canceling or stopping an automatic subscription does not stop the service itself. The service will continue until the renewal date returns and the system finds that the recurring payment has been cancelled. If a service was created on the 15th of the month, this means that the service will continue until the 15th of the following month, regardless of cancellation. At this point the service will be deactivated as no payment will be received at this time to renew the service for another 30 days.
If your service is never canceled in our system, authorization to debit your account will not be stopped and payments will continue to be made. At that time, your service will be paid for and will be active for another billing period which must be renewed on the agreed recurring billing date.
If you have a paypal subscription, you must cancel your paypal subscription directly through paypal. You can do this by logging into the paypal website, clicking on your EasyHost4You subscription, and then clicking cancel subscription. If you do not cancel your Paypal subscription, Paypal will automatically withdraw payment from your account without our knowledge.
At the start of all new services, and only for your first new service with us, we offer a 72 hour money back guarantee. Any desired refund must be requested by opening a billing ticket and must be reviewed and approved by a member of our billing team and/or management. All subscription renewal fees are not eligible for refund of payment. Renewal payments may be redirected and used as credit to another service upon customer request.
Any other refund request submitted to the Billing department after the 72-hour period will be examined on a case-by-case basis. We do not refund issues or complications for which we are not at fault (example: early access game bugs and/or game patches or updates that break certain aspects of the game).
We don't have a Service Level Agreement in place, but we try to compensate for downtime of more than 8 consecutive hours if our systems are confirmed to be faulty. We do not compensate for downtime related to DDoS attacks. Compensation may be given in the form of an account credit or an extension of the subscription billing period. Unfortunately, PayPal subscriptions cannot receive billing extensions because the PayPal subscription system does not allow billing dates to be changed.
We reserve the right to refuse any refund request that we deem unworthy or illegitimate.
The Terms of Service and all matters arising out of or relating to these Terms of Service shall be governed by the laws of the State of Florida, excluding its conflict of law provisions. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded from the application of these Terms of Service. The parties hereby submit to the personal jurisdiction of the state and federal courts in the State of Florida. The exclusive venue for any litigation or arbitration permitted under this Agreement shall be the state and federal courts located in Palm Beach County, Florida.
In the event that a party initiates any claims, actions, formal legal actions, or arbitrations to interpret and/or apply the Terms of Service of this Agreement, or otherwise related to this Agreement, including, without limitation, asserted breaches of representations and warranties, the prevailing party in any such action or proceeding shall be entitled to recover, in addition to all other available remedies, its reasonable attorneys' fees and costs incurred in connection therewith. regard, including attorney's fees incurred on appeal.
If for any reason a court of competent jurisdiction or an arbitrator finds any provision of these Terms of Service, or any part thereof, to be unenforceable, that provision shall be enforced to the maximum extent permitted. and the remainder of these Terms of Service shall survive in full force and effect.
EasyHost4You is not subject to the laws of any nation other than the United States of America.
EasyHost4You reserves the right to revoke or modify these Terms of Service at any time. EasyHost4You reserves the right to refuse service to any person or organization for any reason, and reserves the right to terminate service to any existing customer for any reason.
Customers may wonder why our policies are like this. Technical and legal realities compel us to have them that way. In fact, most companies have similar policies. The best we can do is make it simple and transparent.
